These Terms and Conditions (“Terms”) govern your use of mountainmanmetalworks.com and any online-store, account, quote-request, product-review, or related feature offered through the site. The site is operated by Mountain Man Metal Works (“Mountain Man Metal Works,” “we,” “us,” or “our”). By using the site or placing an order through it, you agree to these Terms. If you do not agree, do not use the site.

Eligibility and Account Information

You must have legal capacity to enter into a binding agreement to place an order or accept a quote. You agree to provide accurate, current, and complete information and to keep account credentials confidential. You are responsible for activity under your account and should notify us promptly of suspected unauthorized use.

Products, Services, and Custom Work

The site presents metal products and services that may include powder coating, gates and handrails, business signs, metal art and décor, and custom fabrication. Product photographs, colors, finishes, measurements, descriptions, and examples are intended to be informative. Screens, lighting, materials, fabrication processes, and handmade or custom work may result in reasonable variations.

Availability, production schedules, customization options, and completion estimates may change. A custom project may require a separate written quote, design approval, deposit, invoice, or order confirmation. Those project-specific documents form part of the agreement and control if they conflict with these general Terms.

You are responsible for reviewing and approving specifications, measurements, spelling, artwork, finishes, quantities, installation requirements, and other project details before production when approval is requested. You represent that you have permission to provide and authorize our use of any design, logo, image, text, trademark, or other material you submit.

Prices, Orders, and Payment

Prices and availability may change without notice before an order is accepted. Taxes, shipping, delivery, installation, customization, and other charges may be added when applicable and will be shown at checkout or in a quote, invoice, or order confirmation.

Submitting an order does not guarantee acceptance. We may reject or cancel an order before fulfillment because of availability, pricing or description errors, suspected fraud, inability to complete the requested work, or other legitimate business reasons. If we cancel after receiving payment, we will return the amount collected for the canceled item or service, subject to any separate written agreement and applicable law.

Payments may be processed by Square or another third-party payment provider. Your use of a payment provider may also be governed by that provider’s terms and privacy notice.

Shipping, Delivery, Pickup, Returns, and Cancellations

Shipping, delivery, pickup, returns, exchanges, cancellations, and refunds are governed by any terms displayed for the relevant product or at checkout and any applicable written quote, invoice, order confirmation, or other agreement. Because products and custom projects differ, contact us before ordering if you need specific timing, delivery, cancellation, return, or refund terms. A separate policy may supplement these Terms when published. Nothing in these Terms limits any non-waivable right provided by applicable law.

Reviews, Comments, and Other Submissions

If you submit a review, comment, photograph, design, or other content, you must have the right to provide it and it must not be unlawful, deceptive, infringing, harmful, or abusive. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and use that content as reasonably needed to operate, improve, and promote the site and our work, subject to applicable privacy law. We may moderate or remove submissions but are not obligated to do so.

Intellectual Property

The site and its text, photographs, graphics, logos, designs, layout, and other content are owned by Mountain Man Metal Works or used with permission and are protected by applicable intellectual-property laws. You may use the site only for personal or internal business purposes related to evaluating or purchasing our products and services. You may not copy, scrape, republish, sell, reverse engineer, or commercially exploit site content without prior written permission, except as permitted by law.

Acceptable Use

You may not use the site to violate law or another person’s rights; transmit malicious code; interfere with site operation or security; gain unauthorized access; submit false information; engage in fraud; or use automated means that place an unreasonable load on the site. Limitation of Liability

To the fullest extent permitted by law, Mountain Man Metal Works and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the site or these Terms. This limitation does not apply where liability cannot lawfully be limited, and it does not alter any express written obligation for an accepted order or project.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Mountain Man Metal Works harmless from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the site, your violation of these Terms, or materials you submit without necessary rights or permission.

Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any mandatory consumer-protection right or other non-waivable law remains in effect.

Changes, Severability, and Waiver

We may update these Terms as the site or our practices change. Updated Terms apply from the effective date shown at the top. If a provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
